ADOPTION OF THE EURO ACT

Chapter 1
GENERAL PROVISIONS

§ 1. Scope of application of Act

This Act determines the conversion of Estonian kroons emitted pursuant to the Money Act of the Republic of Estonia (hereinafter in this Chapter kroons) to euros, withdrawal of kroons from circulation, and parallel circulation of the kroon and the euro.

§ 2. Obligation to accept unlimited euro amounts

(1) Eesti Pank and credit institutions active in Estonia shall be obliged to accept unlimited amounts of euro coins and euro bills.

(2) Persons not provided for in paragraph (1) of this section shall be obliged to accept up to 50 valid euro coins at a time, regardless of the value of the coins, and shall be obliged to accept unlimited amounts of euro bills.

(3) Liability for violation of the obligation prescribed in this section and in section 3 (2) of this Act shall be prescribed in the Consumer Protection Act.

§ 3. Parallel circulation of the kroon and the euro

(1) Bills and coins denominated in kroons shall retain the status of legal means of payment for the duration of 14 days after this Act enters into force.

(2) For the period provided for in subsection (1) of this Act, the persons not provided for in subsection 2 (1) of this Act shall be obliged to accept kroon coins with the total value of up to 20 kroons, and shall be obliged to accept unlimited amounts of kroon bills.

§ 4. Withdrawal of the kroon from circulation

(1) Emission of kroons shall be ended by the date provided for in the Decision of the Council of the European Communities on the abrogation of the derogation of the Republic of Estonia on grounds prescribed in Article 140 (2) of the Treaty on the Functioning of the European Union (hereinafter in this section abrogation of derogation date). Starting from that date, Eesti Pank shall be obliged to withdraw kroons from circulation without service fees.

(2) Eesti Pank shall accept damaged or spoiled kroon bills on the condition that more than half of the bill has been preserved and that the series and number of the bill is legible in entirety, and shall accept damaged or spoiled kroon coins on the condition that at least the nominal value and the date of minting of the coin is legible.

(3) For the purpose of withdrawing kroons from circulation, credit institutions shall be obliged to convert kroons to euros without service fee in branches providing cash services for six months after the abrogation of derogation date. Credit institutions shall convert damaged or spoiled kroon bills and kroon coins to euros on conditions provided for in subsection (2) of this section under authorisation from Eesti Pank.

§ 5. Calculation of kroons into euros

(1) Kroons shall be calculated into euros according to the conversion rate between euro and kroon units which shall be determined by the Council of the European Communities pursuant to Article 140 (3) of the Treaty on the Functioning of the European Union.

(2) The result of the calculation performed according to the procedure prescribed in subsection (1) of this section shall be rounded to the accuracy of 1 cent according to the third decimal place. If the number at the third decimal place is 0-4, the number at the second decimal place shall be unchanged. If the number at the third decimal place is 5-9, the number at the second decimal place shall be rounded up by one.

(3) The withdrawal of the kroon from circulation shall not have the effect of altering any term of a legal instrument or of discharging or excusing performance under any legal instrument, nor give a party the right unilaterally to alter or terminate such an instrument, unless the terms of the instrument or an agreement between the parties provide otherwise.

(4) If any legislation refers to the kroon after the end of the parallel circulation period, such references shall be interpreted as references to the euro according to the conversion rate determined pursuant to the procedure prescribed in subsection (1) of this section and the result shall be rounded pursuant to subsection (2) of this section.

(5) The definition of "instrument" used in subsection (3) of this section shall be interpreted in the sense of Article 1 of the Council Regulation (EC) No 1103/97 on certain provisions relating to the introduction of the euro (OJ L 162, 19.6.1997, pp 1-3).

§ 6. The Marital Property Register Act (RT[1] I 1995, 87, 1540; 2009, 60, 395) shall be amended as follows: in subsection 33 (2), the words "100 kroons" are substituted by the words "5 euros".

§ 7. The Bar Association Act (RT I 2001, 36, 201; 2009, 68, 463) shall be amended as follows:

1) in clause 19 (2) 2), the words "1,000 to 250,000 kroons" are substituted by the words "64 to 16,000 euros

(6) The excise duty rate of diesel fuel is 392.92 euros per 1,000 litres of diesel fuel.

(7) The excise duty rate of special-purpose diesel fuel and light heating oil is 110.95 euros per 1,000 litres of special-purpose diesel fuel or light heating oil.

(8) The excise duty rate of heavy fuel oil is 15.01 euros per 1,000 kilograms of heavy fuel oil.

(9) The excise duty rate of shale-derived fuel oil is 15.01 euros per 1,000 kilograms of shale-derived fuel oil.

(10) The excise duty rate of natural gas is 23.45 euros per 1,000 m³ of natural gas.

(11) The excise duty rate of coal, lignite and coke is 0.30 euros per giga-joule of gross calorific value of coal, lignite and coke.

(11¹) The excise duty rate of oil shale is 0.15 euros per giga-joule of gross calorific value of oil shale and starting from 1 January 2013 it is 0.30 euros per giga-joule of gross calorific value of oil shale.

(12) The excise duty rate of electrical energy is 4.47 euros per megawatt-hour of electrical energy.

(13) The excise duty rate of fuel provided for in subsection 20 (1) of this Act or fuel having a CN with the first six or eight digits being 2707 10, 2707 20, 2707 30, 2707 50, 2710 11 11-2710 11 25, 2710 11 90, 2902 20 00, 2902 30 00, 2902 41 00, 2902 42 00, 2902 43 00 or 2902 44 00 is 422.77 euros per 1,000 litres of fuel.

(14) The excise duty rate of fuel having a CN with eight digits being 2710 19 11 or 2710 19 15 is 330.10 euros per 1,000 litres of fuel.

(15) The excise duty rate of fuel having a CN with the first six digits being 2711 12-2711 14 and used as a motor fuel, including in stationary engines is 125.26 euros per 1,000 kilograms of fuel.

(16) The excise duty rate of fuel having a CN with eight digits being 2710 19 31 or 2710 19 35 is 392.92 euros per 1,000 litres of fuel.

(17) The excise duty rate of fuel having a CN with eight digits being 2710 19 51 or 2710 19 55 is 15.01 euros per 1,000 kilograms of fuel.";

19) in subsection 69⁴ (2), the words "30,000 kroons" are substituted by the words "2,000 euro";

20) in subsection 69⁵ (2), the words "50,000 kroons" are substituted by the words "3,200 euros".

§ 10. The Archives Act (RT I 1998, 36/37, 552; 2009, 62, 405) shall be amended as follows: in subsection 50¹ (2), the words "20,000 kroons" are substituted by the words "1,300 euros".

§ 11. The Law of Property Act (RT I 1993, 39, 590; 2010, 8, 37) shall be amended as follows:

§ 12. The Authorised Public Accountants Act (RT I 2010, 9, 41) shall be amended as follows:

§ 16. The Biocide Act RT I 2009, 29, 174; 49, 331) shall be amended as follows:

1) in subsection 46 (2), the words "100,000 kroons" are substituted by the words "6,400 euros";

2) in subsection 47 (2), the words "500,000 kroons" are substituted by the words "32,000 euros

§ 17. The Digital Signatures Act (RT I 2000, 26, 150; 2009, 1, 3) shall be amended as follows:

1) in clause 18 (1) 2) and clause 25 2), the words "400,000 kroons" are substituted by the words "25,000 euros";

§ 18. The Estonian Development Fund Act (RT I 2006, 52, 385; 2010, 9, 41) shall be amended as follows: in § 45, the words "20,000,000 kroons" are substituted by the words "1,278,233 euros".

§ 19. The Eesti Pank Act (RT I 1993, 28, 498; 2008, 14, 93) shall be amended as follows

1) in subsection 1 (3), the words "Treaty establishing the European Community" are substituted by the words "Treaty on the Functioning of the European Union";

2) subsection 4 (4) is repealed;

3) the title of Chapter II of the Act is amended and worded as follows:

"Chapter II
SUPERVISION AND MANAGEMENT BODIES OF EESTI PANK AND THEIR COMPETENCE";

4) in § 6, the words "highest body" are substituted by the words "supervisory body";

5) subsection 9 (5) is amended and worded as follows:

"(5) Meetings of the Supervisory Board of Eesti Pank shall be closed unless otherwise decided by the Chairman of the Supervisory Board of Eesti Pank. The President and the Vice Presidents of Eesti Pank participate in the meetings with the right to speak. The Minister of Finance of the Republic of Estonia may participate in the meetings, considering the provisions of Article 130 of the Treaty on the Functioning of the European Union.";

6) § 16 is repealed;

7) in subsection 25 (2), the word "kroons" is substituted by the word "euros";

9) subsection 34 (1) is amended and worded as follows

"(1) Taking account of the competence of the European Central Bank and the European System of Central Banks, Eesti Pank shall collect data on the basis and pursuant to the procedure provided by the Official Statistics Act, in order to obtain and publish monetary, financial and balance of payments statistics, necessary for performance of its functions."

§ 20. The Act to Amend Eesti Pank Act (RT I 2006, 29, 219) shall be amended as follows:

1) in § 2, the words "Treaty establishing the European Community" of second sentence of subsection 2 (1) of the Eesti Pank Act are substituted by the words "Treaty on the Functioning of the European Union";

2) in clause 7 5), the wording of clause 9 (2) 9) of the Eesti Pank Act is amended to be as follows:

"9) making decisions about the design of the national side of the new euro coins and about the nominal value and design of souvenir coins according to the procedure prescribed in the legislation of the European Union;";

3) in § 12, the wording of the introductory sentence part of subsection 14 (1) of the Eesti Pank Act shall be amended to be as follows:

"(1) Taking account of the competence of the European Central Bank and the European System of Central Banks, Eesti Pank is entitled to the following in order to perform its duties:";

4) in subsection 20 (2), the words "cancelling according to the procedure prescribed in Article 122 (2) of the Treaty establishing the European Community" are substituted by the words "repealing on grounds provided for in article 140 (2) of the Treaty on the Functioning of the European".

§ 21. The Estonian National Broadcasting Act (RT I 2007, 10, 46; 66, 408) shall be amended as follows:

1) in clauses 21 (2) 2) and 3), the words "1,000,000 (one million) kroons" are substituted by the words "64,000 euros";

2) in subsection 34 (7) and subsection 37 (4), the words "10,000 kroons" are substituted by the words "640 euros".

§ 22. The Procedure for Registration and Disclosure of Persons who Have Served in or Co-operated with Intelligence or Counter-intelligence Organisations of Security Organisations or Military Forces of States which Have Occupied Estonia Act (RT I 1995, 17, 233; 2002, 61, 375) shall be amended as follows:
In subsection 8¹ (4), the words "10,000 kroons" are substituted by the words "640 euros".

§ 23. The Act to Amend Republic of Estonia Bankruptcy Act (RT I 1997, 5/6, 32; 2003, 13, 64) is repealed.

§ 24. The Republic of Estonia Money Act (RT 1992, 21, 299; RT I 2009, 62, 405) is repealed

§ 25. The Republic of Estonia Securing the Estonian Kroon Act (RT 1992, 21, 300) is repealed.

§ 26. The Estonian Central Register of Securities Act (RT I 2000, 57, 373; 2010, 9, 41) shall be amended as follows:

1) in subsection 40 (4), the words "18,000 kroons" are substituted by the words "1,200 euros", the words "93,000 kroons" are substituted by the words "6,000 euros", the words "50,000 kroons" are substituted by the words "3,200 euros" and the words "800,000 kroons" are substituted by the words "52,000 euros";

2) in §§ 46¹, 46², 46³ and subsection 46⁴ (2), the words "500,000 kroons" are substituted by the words "32,000 euros";

§ 27. The Building Act (RT I 2002, 47, 297; 2010, 8, 37) shall be amended as follows:

§ 40. The European Union Common Agricultural Policy Implementation Act (RT I 2009, 56, 375; 2010, 10, 43) shall be amended as follows:

(2) In regard with adoption of the euro in Estonia, amendments in rules or articles of association of the fund are not required to be co-ordinated with the Financial Supervision Authority if the following conditions are met:
1) only such provisions are amended in rules or articles of association of the fund which the management company is obliged to amend due to adoption of the euro in Estonia;
2) the amended rules or articles of association of the fund are presented to the Financial Supervision Authority.

(3) The nominal values of units in funds with rules registered before the date provided for in the Decision of the Council of the European Communities on the abrogation of the derogation of the Republic of Estonia on grounds prescribed in Article 140 (2) of the Treaty on the Functioning of the European Union shall be converted into euros pursuant to the provisions of § 5 of the Adoption of the Euro Act."

§ 55. The Personal Data Protection Act (RT I 2007, 24, 127; 2007, 68, 421) shall be amended as follows:

1) in the third sentence of subsection 19 (2), the words "three kroons" are substituted by the words "0.20 euros";

2) in subsection 40 (2), the words "150,000 kroons" are substituted by the words "9,600 euros";

"Pollution charge rates for the emission of one ton of pollutant into a water body, groundwater or soil are the following:
1) organic matter, except for those specified in clauses 6) and 7) of this subsection, calculated as the biochemical oxygen demand for the decomposition of such matter during seven twenty-four hour periods (BOD₇) - 1,379 euros as of 1 January 2011, 1,392 euros as of 1 January 2012, 1,406 euros as of 1 January 2013, 1,420 euros as of 1 January 2014, 1,435 euros as of 1 January 2015;
2) phosphorous compounds, calculated as total phosphorus (P_tot) - 4,206 euros as of 1 January 2011, 5,468 euros as of 1 January 2012, 7,109 euros as of 1 January 2013, 9,241 euros as of 1 January 2014, 12,014 euros as of 1 January 2015;
3) nitrogen oxides, calculated as total nitrogen (N_tot) - 1,616 euros as of 1 January 2011, 1,858 euros as of 1 January 2012, 2,137 euros as of 1 January 2013, 2,457 euros as of 1 January 2014, 2,826 euros as of 1 January 2015;
4) suspended solids - 377.65 euros as of 1 January 2011, 415.42 euros as of 1 January 2012, 456.96 euros as of 1 January 2013, 502.66 euros as of 1 January 2014, 552.89 euros as of 1 January 2015;
5) sulphates, calculated as sulphate ions (SO₄^2-) - 5.81 euros as of 1 January 2011, 6.13 euros as of 1 January 2012, 6.45 euros as of 1 January 2013, 6.77 euros as of 1 January 2014, 7.09 euros as of 1 January 2015;
6) monophenols - 11,731 euros as of 1 January 2011, 14,077 euros as of 1 January 2012, 16,893 euros as of 1 January 2013, 20,272 euros as of 1 January 2014, 24,326 euros as of 1 January 2015;
7) oil, oil products, mineral oil or liquid products obtained from the thermal treatment of solid fuel or other organic matter - 2,620 euros as of 1 January 2011, 3,013 euros as of 1 January 2012, 3,465 euros as of 1 January 2013, 3,985 euros as of 1 January 2014, 4,582 euros as of 1 January 2015;
8) other hazardous waste within the meaning of the Water Act not specified in clauses 1)-7) of this subsection - 12,039 euros as of 1 January 2011, 13,844 euros as of 1 January 2012, 15,921 euros as of 1 January 2013, 18,309 euros as of 1 January 2014, 21,056 euros as of 1 January 2015.";

10) subsection 20 (4) is amended and worded as follows:

"(4) In addition to the pollution charge rates established in subsection (1) of this section, if the pH of waste water directed into a water body is higher than 9.0 or less than 6.0, the pollution charge shall be paid at a rate of 0.19 euros per each tenth of pH unit by which the pH of the waste water is higher than 9.0 or less than 6.0 per cubic metre of waste water.";

11) clause 21 (1) 1) is amended and worded as follows:

"1) non-hazardous and hazardous waste deposit of which is permitted in a landfill for non-hazardous waste based on the waste permit or integrated environmental permit for the operation of landfills held by the possessor of the landfill, except for the waste specified in clauses 5)-9) of this subsection - 14.38 euros as of 1 January 2011, 17.25 euros as of 1 January 2012, 20.77 euros as of 1 January 2013, 24.86 euros as of 1 January 2014, 29.84 euros as of 1 January 2015;";

12) clauses 21 (1) 4)-9) are amended and worded as follows:

"4) waste from building materials and construction demolition waste containing asbestos - 0.63 euros;
5) mine waste from oil shale, including waste from mineral dressing, discharged into open dumps - 0.76 euros;
6) waste which contains wood preservatives, inorganic pesticides, asbestos, arsenic or lead, except for the waste specified in clause 4) of this section, coal and oil shale tar and products thereof, as well as bituminous compounds containing such materials and waste pitch from the processing of oil shale - 62.56 euros;
7) waste which contains mercury, cadmium, cyanides, polychlorinated biphenyls or polychlorinated terphenyls (PCBs, PCTs) or organic pesticides - 625.56 euros;
8) oil shale fly ash and oil shale bottom ash and cement clinker dust - 1.44 euros as of 1 January 2011, 1.72 euros as of 1 January 2012, 2.07 euros as of 1 January 2013, 2.48 euros as of 1 January 2014, 2.98 euros as of 1 January 2015;
9) oil shale semi-coke - 1.44 euros as of 1 January 2011, 1.72 euros as of 1 January 2012, 2.07 euros as of 1 January 2013, 2.48 euros as of 1 January 2014, 2.98 euros as of 1 January 2015;";

13) subsection 23 (2) is amended and worded as follows:

"(2) Upon emission of carbon dioxide into ambient air from a stationary source of pollution in larger quantities than permitted in the trade licence and which is not reflected in the annual report, the pollution charge for one ton of carbon dioxide shall be 99.70 euros.";

14) the third and the fourth sentence of subsection 31 (4) are amended and worded as follows:

"The calculations shall be submitted to the accuracy of 0.10 euros. Amounts less than 5 cents shall be omitted and amounts exceeding 5 cents shall be rounded up to the nearest 10 cents.";

15) in subsection 32 (7), the words "2,000 kroons" are substituted by the words "130 euros";

16) in subsection 35 (2), the words "10,000 kroons" are substituted by the words "640 euros";

17) in subsection 37 (9), the words "in full kroons" are substituted by the words "to the accuracy of 0.10 euros";

18) in subsection 37 (10), the words "less than 2,000 kroons" are substituted by the words "less than 130 euros" and the words "exceeds 2,000 kroons" are substituted by the words "exceeds 130 euros".

§ 73. The Environmental Liability Act (RT I 2007, 62, 396; 2009, 49, 331) shall be amended as follows:

1) in subsection 34 (4), the words "150,000 kroons" are substituted by the words "9,600 euros";

2) in subsection 36 (2), the words "500,000 kroons" are substituted by the words "32,000 euros";

3) in subsection 37 (2), the words "300,000 kroons" are substituted by the words "20,000 euros";

4) in subsection 38 (2), the words "500,000 kroons" are substituted by the words "32,000 euros".

§ 74. The Radiation Act (RT I 2004, 26, 173; 2009, 48, 322) shall be amended as follows: in subsection 6 4(2), subsection 64¹ (2), subsection 65 (2), subsection 66 (2) and subsection 67 (2), the words "50,000 kroons" are substituted by the words "3,200 euros".

§ 75. The Insurance Activities Act (RT I 2004, 90, 616; 2010, 9, 41) shall be amended as follows:

1) the words "in Estonian kroons or" are omitted from clause 77 (5) 3);

2)the words "in Estonian kroons or" are omitted from second sentence of subsection 78¹ (1);

3) in subsection 181 (2), the words "18,000 kroons" are substituted by the words "1,200 euros", the words "75,000 kroons" are substituted by the words "4,800 euros", the words "50,000 kroons" are substituted by the words "3,200 euros" and the words "750,000 kroons" are substituted by the words "48,000 euros";

§ 76. The Land Register Act (RT I 1993, 65, 922; 2009, 61, 401) shall be amended as follows:

2) in subsection 51 (2), the words "500 kroons" are substituted by the words "30 euros";

3) § 79⁶ is added to the Act worded as follows:

""§ 79⁶. Specifics of currency used

(1) In land register records made before the date provided for in the Decision of the Council of the European Communities on the abrogation of the derogation of the Republic of Estonia on grounds prescribed in Article 140 (2) of the Treaty on the Functioning of the European Union (hereinafter in this section abrogation of derogation date), monetary amounts shall be expressed in Estonian kroons.

(2) § 37¹ of this Act shall also apply to the entering of monetary amounts into the land register if the application for entry is submitted to the land registry department before the abrogation of derogation date but the record is made after the abrogation of derogation date."

§ 77. The Funded Pensions Act (RT I 2004, 37, 252; 2009, 26, 161) shall be amended as follows:

1) subsection 11 (5) is repealed;

2) in subsection 54 (1), the words "500 kroons" are substituted by the words "30 euros".

§ 78. The Local Government Organisation Act (RT I 1993, 37, 558; 2009, 62, 405) shall be amended as follows: in subsection 66² (2), the words "20,000 kroons" are substituted by the words "1,300 euros".

§ 79. The Local Government Council Election Act (RT I 2002, 36, 220; 2009, 27, 165) shall be amended as follows:

1) in clause 60 (1) 3) and clause 61 (1) 5), the words "in kroons" are substituted by the words "in euros";

(2) If an execution document for payment by the obligor of an amount exceeding 3,200 euros to the claimant is submitted for enforcement, the bailiff's fee shall be calculated as follows:
1) a bailiff's fee on an amount of claim of 3,201-3,900 euros shall be 14.75% of the amount of the claim;
2) a bailiff's fee on an amount of claim of 3,901-4,500 euros shall be 13.75% of the amount of the claim;
3) a bailiff's fee on an amount of claim of 4,501-5,100 euros shall be 12.25% of the amount of the claim;
4) a bailiff's fee on an amount of claim of 5,101-5,800 euros shall be 11.25% of the amount of the claim;
5) a bailiff's fee on an amount of claim of 5,801-6,400 euros shall be 10.5% of the amount of the claim;
6) a bailiff's fee on an amount of claim of 6,401-13,000 euros shall be 9.5% of the amount of the claim;
7) a bailiff's fee on an amount of claim of 13,001-25,500 euros shall be 9.25% of the amount of the claim;
8) a bailiff's fee on an amount of claim of 25,501-38,400 euros shall be 9% of the amount of the claim;
9) a bailiff's fee on an amount of claim of 38,401-51,200 euros shall be 8.75% of the amount of the claim;
10) a bailiff's fee on an amount of claim of 51,201-63,900 euros shall be 8.5% of the amount of the claim;
11) a bailiff's fee on an amount of claim of 63,901-127,800 euros shall be 8% of the amount of the claim;
12) a bailiff's fee on an amount of claim of 127,801-191,800 euros shall be 7.5% of the amount of the claim;
13) a bailiff's fee on an amount of claim of 191,801-255,700 euros shall be 7.25% of the amount of the claim;
14) a bailiff's fee on an amount of claim of 255,701-319,600 euros shall be 6.5% of the amount of the claim;
15) a bailiff's fee on an amount of claim of 319,601-383,500 euros shall be 5.5% of the amount of the claim;
16) a bailiff's fee on an amount of claim of 383,501-447,400 euros shall be 4.75% of the amount of the claim;
17) a bailiff's fee on an amount of claim of 447,401-511,300 euros shall be 4.5% of the amount of the claim;
18) a bailiff's fee on an amount of claim of 511,301-575,000 shall be 4% of the amount of the claim.

(3) The rate of bailiff's fee for a claim the amount of which is greater than 575,000 euros shall be 23,000 euros + 0.5% for an amount which exceeds 575,000 euros.

(4) The advance payment of a bailiff's fee shall be 200 euros on the amounts of claim specified in subsection
(2) of this section and 320 euros on the amounts of claim specified in subsection (3) of this section.";

4) in subsection 36 (2), the words "2,200 kroons" are substituted by the words "140 euros" and the words "1,450 kroons" are substituted by the words "95 euros";

(2) If a ruling for securing an action concerns a non-monetary claim or the value of the action has not been determined or is unspecified, and in the case of enforcement of a ruling for revocation of securing an action or enforcement of a judgment, the bailiff's fee shall be 95 euros.";

"§ 38. Specifics of currency used

(1) Before the date provided for in the Decision of the Council of the European Communities on the abrogation of the derogation of the Republic of Estonia on grounds prescribed in Article 140 (2) of the Treaty on the Functioning of the European Union (hereinafter in this section abrogation of derogation date), the pledge amounts entered into the commercial pledge register shall be expressed in Estonian kroons.

(2) The pledge amounts entered into the commercial pledge register shall be expressed in euros if the application for entry is submitted to the registrar before the abrogation of derogation date but the record is made after the abrogation of derogation date."

§ 85. The Competition Act (RT I 2001, 56, 332; 2010, 8, 34) shall be amended as follows:

1) in subsection 21 (1), the words "100 million kroons" are substituted by the words "6,391,200 euros" and the words "30 million kroons" are substituted by the words "1,917,350 euros";

2) in subsection 62 (3), the words "50,000 kroons" are substituted by the words "3,200 euros" and the words "100,000 kroons" are substituted by the words "6,400 euros";

3) in § 73¹, the words "50,000 kroons" are substituted by the words "3,200 euros";

2) the text of § 3 is deemed subsection (1) and subsection (2) is added to § 3 worded as follows:

"(2) Provisions of §§ 525¹ and 525² of the Commercial Code shall not apply to the association.";

§ 203. The Employees' Representatives Act (RT I 2007, 2, 6; 2009, 5, 35) shall be amended as follows: in subsection 24 (2), the words "50,000 kroons" are substituted by the words "3,200 euros".

§ 207. The Unemployment Insurance Act (RT I 2001, 59, 359; 2009, 36, 234) shall be amended as follows: subsection 42 (3) is amended and worded as follows:

"(3) The amount of unemployment insurance premium calculated for each insured person and payable by employers shall be rounded to the accuracy of one cent."

§ 208. The Sworn Translators Act (RT I 2001, 16, 70; 2009, 27, 164) shall be amended as follows: in subsections 8 (1) and (2), the words "50 kroons" are substituted by the words "3.15 euros".

§ 209. The Parental Benefit Act (RT I 2003, 82, 549; 2009, 5, 35) shall be amended as follows: the third sentence of subsection 4 (6) is amended and worded as follows:

"Upon payment of the benefit and calculation of the sum withheld from the benefit, sums shall be rounded to the accuracy of one cent."

§ 210. The Fiscal Marking of Liquid Fuel Act (RT I 1997, 73, 1201; 2009, 62, 405) shall be amended as follows: in subsection 6² (2) and subsection 6³ (2), the words "50,000 kroons" are substituted by the words "3,200 euros".

§ 211. The Liquid Fuel Act (RT I 2003, 21, 127; 2009, 62, 405) shall be amended as follows:

1) in subsections 3 (3), (5) and (5¹), the words "500,000 kroons" are substituted by the words "31,950 euros";

2) in subsections 3 (4) and (5²2), the words "10 million kroons" are substituted by the words "639,115 euros";

3) in subsection 25 (5), the words "10,000 kroons" are substituted by the words "640 euros";

4) in subsection 30 (2), subsection 31 (2), subsection 32 (2) and § 33, the words "50,000 kroons" are substituted by the words "3,200 euros".

§ 212. The Liquid Fuel Stocks Act (RT I 2005, 13, 66; 2009, 57, 381) shall be amended as follows:

1) in subsection 10 (1), the words "in kroons" are substituted by the words "in euros";

2) subsections 10 (6)-(8) are amended and worded as follows:

"(6) The minimum and maximum rate of stockpiling fee depends on the costs of holding volumes of stock corresponding to the stocks prescribed for one day which, in case of fuels in stock categories I and II shall be expressed in euros for 1,000 litres of fuel and in case of fuels in stock category III shall be expressed in euros for 1,000 kilograms of fuel.

(7) The minimum rate of stockpiling fee corresponding to the stock prescribed for one day shall be 0.026 euros and the maximum rate shall be 0.16 euros per 1,000 litres of fuel. Upon establishment of a separate rate of stockpiling fee for aviation kerosene maintained as aircraft fuel in stock category II, the minimum rate of stockpiling fee corresponding to the stock prescribed for one day shall be 0.026 euros and the maximum rate shall be 0.19 euros per 1000 litres of fuel.

(8) The minimum rate of stockpiling fee corresponding to the stock in stock category III prescribed for one day shall be 0.064 euros and the maximum rate shall be 0.256 euros per 1,000 kilograms of fuel.";

3) in subsection 20 (2) and subsection 20¹ (2), the words "50,000 kroons" are substituted by the words "3,200 euros";

4) in subsection 21 (2), the words "30,000 kroons" are substituted by the words "2,000 euros".

§ 213. The Water Act (RT I 1994, 40, 655; 2010, 8, 37) shall be amended as follows:

1) in subsection 38³ (2), subsection 38⁴ (2), subsection 38⁵ (2) and subsection 38⁸ (2), the words "30,000 kroons" are substituted by the words "2,000 euros";

§ 224. The Unlawfully Expropriated Property Valuation and Compensation Act (RT 1993, 30, 509; RT I 2006, 7, 40) shall be amended as follows:

1) § 7 is amended and worded as follows:

"§ 7. Converting into euros the value of the property as at the time of expropriation

(1) The value of property as at the time of expropriation expressed in kroons valid in year 1940 shall be converted into euros according to the exchange rate of 1 kroon = 0.64 euros. The value of property as at the time of expropriation expressed in a foreign currency shall converted into kroons valid in year 1940 according to the coefficients prescribed by the Minister of Finances.

(2) The value of property as at the time of expropriation expressed in the currency of the USSR (roubles) shall be converted into euros according to the coefficients prescribed by the Minister of Finances.

(3) The converted value shall be expressed to the accuracy of one euro.";

2) in § 12, the words "3,000 EEK" are substituted by the words "192 euros";

3) in subsection 13 (3), the words "100 EEK" are substituted by the words "6.40 euros";

Entry into Force of Act

§ 231. Entry into force of Act

(1) This Act enters into force on the date provided for in the Decision of the Council of the European Communities on the abrogation of the derogation of the Republic of Estonia on grounds prescribed in Article 140 (2) of the Treaty on the Functioning of the European Union.

(2) § 20 of this Act enters into force one day before the date provided for in subsection (1) of this section.

(3) Clause 65 2) enters into force on the 15th day after the date provided for in subsection (1) of this section.
